Why do I need a Will?
It’s the only way to ensure that your wishes are carried out after you die. Without a valid Will, your property will pass according to the Law of Intestacy, which may not be what you would have wished. Having a Will makes the process of finalising your affairs quicker and easier too.
Without a Will, your beneficiaries may not be able to access any money from your estate, which can lead to distress for your family.
As a single person you may wish to divide your estate amongst friends, relatives and favourite charities and confirm who gets what.
As a married person, don’t simply assume your spouse will be entitled to everything. Brothers and sisters or parents, grandchildren and even cousins may be able to make a claim. Often your children have a right to part of your estate. However, if you are co-habiting but not actually married or in a civil partnership, you are likely to be treated as a single person; your surviving partner may receive nothing! They certainly don’t need to have to cope with financial stress and possible disappointment, delays, disputes and potential legal action after the loss of a loved one.
As a parent, it is important to think about who will look after your children and make suitable financial provision to help pay for their maintenance. It’s particularly important for one-parent families or unmarried parents living together to nominate guardians. If you don’t spell out what you want, a Court will decide your children’s future, which may not be at all what you would have wished.
Don’t forget to review your Will regularly. If you made a Will many years ago, your circumstances or preferences may have changed. Remarriage or divorce will nullify any previous provisions you made. Perhaps you now have additional dependents or grandchildren, or there may be people you no longer wish to benefit from your estate. The people you appointed as Executors may have predeceased you or no longer wish (or be able) to act.
A Will brings security, reassurance and peace of mind, not just for you but for all those who depend on you, now and in the future.
